Terms and Conditions

By applying to join the FDEA  and signing up to our member portal (“The site”), www.members.ukfdea.com, you agree to be legally bound by these terms. If you do not agree to be legally bound by all the following terms, do not continue with your membership application nor access the site.

Professional Membership

When you submit your application on line, or telephone or email us with details of your application, you are making an offer to subscribe to our membership which, if accepted by us, will result in a legally binding contract.

At the point of renewal of your membership, your renewal payment is confirmation of the continued acceptance of this contract. You may not transfer any of your rights and obligations under these terms and conditions to another company. 

If you are accepted into membership, but it subsequently turns out that any or all of the information provided by you was misleading or false, we reserve the right to revoke the membership with immediate effect, without the right of appeal or refund.

Payment

Access to our professional membership is only available to professionals holding an active membership subscription.

We reserve the right not to fulfil, or to cancel, your application if we are unable to obtain payment authorisation from the issuer of your card or from your bank in the case of direct debit payments.

Payment for membership renewal is due by 23:59 on the day your membership expires to maintain continuous access to member benefits.

Your membership is a rolling agreement which will automatically renew upon the anniversary of your acceptance. You will receive a renewal notice in advance of the anniversary of your application date, informing you of your entitlement to cancel and of any changes to your renewal fee. Any payment arrangements that have been set up by Direct Debit or credit card subscription will automatically continue.

Monthly Membership

The minimum terms for monthly paid membership is 1 year from the time of joining.  Payment will be taken on the same day each month in 12 equal monthly instalments.  You will be able to cancel your membership after 1 year or continue monthly instalments for the next fixed 12 month period.

Force Majeure

FDEA shall not be liable to the user for any non performance of its obligations by reason of matters beyond its control including, but not limited to, any act of terrorism, war, riot, civil commotion, compliance with any law or government order, fire, flood or storm, strikes, or any other industrial dispute, delay in transit, power failure, postal delay, or any event that cannot be reasonably be planned for or avoided.

In the event of Force Majeure we will continue our services as soon as reasonably possible.

Termination

We offer a seven working days’ cooling off period for new members starting from when your membership is activated.

This allows you to cancel your subscription without penalty. If you wish to cancel your new subscription, you must notify us within these seven working days in writing by letter or email.

Fees

Fees displayed on the application section of the website will prevail at all times.

Membership is charged for a 12 month period (paid in monthly instalments or annually).  All memberships are subscription based with payment by direct debit or credit card subscription,

We reserve the right to increase the price of the membership subscription on an annual basis. You will be informed of any fee increase within your renewal letter. If we discover an error in the price of your membership subscription, we will inform you as soon as is reasonably possible.

Variation

We may change these terms and conditions at any time upon giving you 14 days prior written notice. The most recent edition of these terms and conditions will be binding upon you.

Members may exit the contract without penalty if they do not accept any proposed variation.

The FDEA may change these terms at any time by posting changes. Please review these terms regularly to ensure you are aware of any changes made by the FDEA. Your continued use of the site after changes are posted means you agree to be legally bound by these terms as updated or amended. Users will be notified of any such changes.

In accordance with the Data Protection Act 2018 and General Data Protection Regulation personal information held in both computerised and manually filed records will:

  • Be obtained and processed fairly and lawfully
  • Be used only for the specific purposes for which it was obtained and not in any manner incompatible with those purposes
  • Be adequate, relevant and not excessive for those purposes
  • Not kept longer than is necessary for those purposes
  • Be processed in accordance with individuals’ rights under the Act
  • Be protected from unauthorised access, unlawful processing, accidental loss, destruction or damage
  • Not be transferred to a country which does not ensure adequate protection for the rights of individuals in relation to the processing of personal information

As part of your membership with FDEA you will receive regular key communications as standard relating to Exporting News, Events and Conferences etc.

We provide you with the ability to manage all communication preferences and update your contact details via your online account under Settings. If you have any difficulty updating your details or preferences please contact Helpdesk on the FDEA portal.

Use of the FDEA website

You may not copy, reproduce, republish, or otherwise use the FDEA Site content in any way except for Permitted Use. You also agree not to adapt, alter or create a derivative work from any Site Content except for Permitted Use. Any other use of Site Content requires the prior written permission of the FDEA.

You agree to use the FDEA website only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else’s use and enjoyment of the FDEA site. Prohibited behavior includes harassing or causing distress or inconvenience to any person, transmitting obscene or offensive content or disrupting the normal flow of dialogue within this site.

Liability

The FDEA endeavours to ensure that FDEA Site Content is accurate. However, Site Content is for general guidance only and is provided without any representations or any kind of warranty made (whether express or implied by law), including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.

The FDEA will not be liable for any damages, including indirect or consequential damages, or any damages arising from use or loss of use, data or profits, whether in contract, negligence or other tortious action, arising from or in connection with the use of this site and the Site Contents.

The FDEA does not warrant that functions contained in the contents of this site will be uninterrupted or error free, that defects will be corrected, or that this site, or the server that makes it available are free of viruses or bugs.

Intellectual property

The names, images and logos identifying the FDEA or third parties are subject to copyright, design rights and trademarks of the FDEA and/or third parties. Nothing contained in these terms shall be construed as conferring by implication, estoppel or otherwise any license or right to use any trademark, patent, design right or copyright of the FDEA or any other third party.

This site contains links to other related Internet sites. You might find these links useful, though as they are outside of our control, we cannot take responsibility for their content nor should links be taken as an endorsement of any kind. We have no control over linked pages’ availability. We do not endorse any other organisations, products, websites or services mentioned on this site unless otherwise stated on the relevant pages. We cannot be held responsible for any advice or recommendations obtained from these links and anyone accessing these links from our website does so on this understanding.

General

If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and effect and continue to be binding and enforceable.

These terms shall be governed by and interpreted in accordance with the laws of England and Wales.

Definitions

In this agreement, unless the context otherwise requires:
 
 “Permitted Use” means use within the business included within your current subscription to FDEA, but does not include disclosure to persons who are not members of FDEA.
 “Site Content” means the content of all the FDEA website and member portal, including data, information, names, images, pictures, logos and icons regarding or relating to the FDEA and to third parties

These terms and conditions may evolve and will be reflected on this page.

Guidelines – Posting to forums and sending private messages

The FDEA is committed to creating a non-discriminatory, respectful and supportive online community for our members. 

While using the FDEA website you must not;

  • post any material which may cause offence or is illegal. The result in doing so will be immediate and permanent removal from all areas of the community and possible legal action 
  • breach any terms and conditions 
  • knowingly post false, inaccurate or misleading content. 
  • post abusive or insulting comments or messages, this will not be tolerated on the FDEA community. Harassment can be described as unwanted conduct or attacking other members of the community 
  • post spam 
  • distribute viruses or any other technologies that may harm the community 
  • collect other members details without their consent 
  • post any copyrighted material unless the copyright is owned by you 
  • make comments on an individual’s view point, products or companies unless they are objective and fair  
  • incite hatred on the basis of race, religion, gender, nationality, sexuality or personal characteristic 
  • call into account a person’s professional standing, swear, or make obscene or vulgar comments 
  • advertise products or services 
  • falsely claim to represent a person or organisation 
  • invade people’s privacy by posting their private addresses, phone numbers, emails or other personal details 
  • deliberately attempt to embarrass alarm, intimidate or annoy any other member of the BVNA community
  • post messages that are unrelated to the online forums
  • do anything to jeopardise the integrity of the internet or the FDEA’s IT systems, by introducing viruses, Trojans, worms or any other damaging code into the system

 

FDEA provides the FDEA community in good faith as a resource to network and debate with fellow community members.

If a post violates the forum rules, it will be deleted and returned to the participant with a warning, along with reference to the broken rules.

If a participant continues to break the rules after warnings, they will be banned from using the FDEA community. 

Cyberbullying

Cyberbullying can be defined as using “…the Internet, cell phones or other devices to send or post text or images intended to hurt, embarrass or intimidate another person.”

Any posts making community members the subject of ridicule in forums, and posting false statements will not be tolerated. 

In using our discussion forums and private messaging you;

  • acknowledge that all information posted on any forum or private message is the sole responsibility of the person from which such content originated 
  • understand that this means that you are entirely responsible for all content that you upload, post or email via the forums 
  • understand that FDEA does not control the content posted via the forums and does not guarantee the accuracy or quality of the content 
  • understand that under no circumstances will FDEA be liable in any way for any content, including, but not limited to, any errors in any content, or for any loss or damage incurred as a result of the use of any content posted via the forums 

The FDEA will not be liable for any posts made or messages sent by members on the community. Members are responsible for their own words and uploads.

Website Privacy

The FDEA will not sell or distribute your personal information to third parties for any marketing without your explicit consent.  See our members Privacy Policy.

Username and Passwords

Access to some areas of the FDEA website require you to use an identity; a username and a password. You are entirely responsible for maintaining the confidentiality of your Account Information and for any and all activity that occurs under your account.

Governing Law

These terms and conditions are governed by English law. You hereby irrevocably submit to the exclusive jurisdiction of the English courts notwithstanding the jurisdiction where you are based.

If any English court or competent authority decides that any of the provisions of these Terms and Conditions are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law.

We will respond to any complaint or query received within five working days. This may be an acknowledgement that we have received a complaint whilst further investigations are carried out.
